Terms & Conditions

The following terms and conditions apply to all website development / design services provided by Aim High Web Design to the Client.

1. Acceptance

It is not necessary for any Client to have signed an acceptance of these terms and conditions for them to apply. If a Client accepts a quote then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Please read these terms and conditions carefully. Any purchase or use of our services implies that you have read and accepted our terms and conditions.

2. Charges

Charges for services to be provided by Aim High Web Design are defined in the project quotation that the Client receives via e-mail. Quotations are valid for a period of 30 days. Aim High Web Design reserves the right to alter or decline to provide a quotation after expiry of the 30 days.

Payment for all services is 100% of the cost upfront. Once payment has cleared into the bank account of Aim High Web Design, work will commence.

Aim High Web Design “may” on certain occasions offer a part pay option. If this is the case the client agrees to pay Aim High Web Design 50% of the order value upfront. A further 25% will be paid when the client signs off the final design. The remaining 25% will be paid on completion of the project, before the final product is delivered (to client, printing press, bindery, mail house or ”have it go live” in the World Wide Web).

Payment for services is due by bank transfer. Bank details will be made available on invoices.

3. Client Review

Aim High Web Design will provide the Client with an opportunity to review the appearance and content of the website during the design phase and once the overall website development is completed. At the completion of the project, such materials will be deemed to be accepted and approved unless the Client notifies Aim High Web Design otherwise within ten (10) days of the date the materials are made available to the Client.

4. Turnaround Time and Content Control

Aim High Web Design will install and publicly post or supply the Client’s website by the date specified in the project proposal, or at date agreed with Client upon Aim High Web Design receiving initial payment, unless a delay is specifically requested by the Client and agreed by Aim High Web Design.

In return, the Client agrees to delegate a single individual as a primary contact to aid Aim High Web Design with progressing the commission in a satisfactory and expedient manner.

During the project, Aim High Web Design will require the Client to provide website content; text, images, movies and sound files

The client will assume any printing, hosting, binding, shipping or insurance costs related to the project. Any alteration or deviation from the above specifications involving extra costs will be executed only upon approval with the client. Aim High Web Design shall not incur any liability or penalty for delays in the completion of the project due to actions or negligence of client, unusual transportation delays, unforeseen illness, or external forces beyond the control of Aim High Web Design. If such event(s) occur, it shall entitle Aim High Web Design to extend the completion/delivery date, by the time equivalent to the period of such delay.

5. Failure to provide required website content:

Aim High Web Design is a small business, to remain efficient we must ensure that work we have programmed is carried out at the scheduled time. On occasions we may have to reject offers for other work and enquiries to ensure that your work is completed at the time arranged.

This is why we ask that you provide all the required information in advance. On any occasion where progress cannot be made with your website because we have not been given the required information in the agreed time frame, and we are delayed as result, we reserve the right to impose a surcharge of up to 25%. If your project involves Search Engine Optimisation we need the text content for your site in advance so that the SEO can be planned and completed efficiently.

If you agree to provide us with the required information and subsequently fail to do within one week of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, all the above condition says is do not give us the go ahead to start until you are ready to do so.

NOTE: Text content should be delivered as a Microsoft Word, email (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages should have the same titles as the agreed website pages. Contact us if you need clarification on this.

Using our content management system you are able to keep your content up to date your self.  We can provide training on this, please ask.

6. Payment

Invoices will be provided by Aim High Web Design upon completion but before publishing the live website. Invoices are normally sent via email; however, the Client may choose to receive hard copy invoices. Invoices are due upon receipt. Accounts that remain unpaid thirty (30) days after the date of the invoice will be assessed a service charge in the amount of the higher of one and one-half percent (1.5%) or £30 per month of the total amount due.

7. Additional Expenses

Client agrees to reimburse Aim High Web Design for any additional expenses necessary for the completion of the work. Examples would be purchase of special fonts, stock photography etc.

8. Web Browsers

Aim High Web Design makes every effort to ensure websites are designed to be viewed by the majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9, Google Chrome, etc.). Client agrees that Aim High Web Design cannot guarantee correct functionality with all browser software across different operating systems.

Aim High Web Design cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the Client. As such, Aim High Web Design reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software.

9. Default

Accounts unpaid thirty (30) days after the date of invoice will be considered in default. If the Client in default maintains any information or files on Aim High Web Design’s Web space, Aim High Web Design will, at its discretion, remove all such material from its web space. Aim High Web Design is not responsible for any loss of data incurred due to the removal of the service. Removal of such material does not relieve the Client of the obligation to pay any outstanding charges assessed to the Client’s account.  Clients with accounts in default agree to pay Aim High Web Design reasonable expenses, including legal fees and costs for collection by third-party agencies, incurred by Aim High Web Design in enforcing these Terms and Conditions.

10. Termination

Termination of services by the Client must be requested in a written notice and will be effective on receipt of such notice. E-mail or telephone requests for termination of services will not be honoured until and unless confirmed in writing. The Client will be invoiced for design work completed to the date of first notice of cancellation for payment in full within thirty (30) days.

11. Indemnity

All Aim High Web Design services may be used for lawful purposes only. You agree to indemnify and hold Aim High Web Design harmless from any claims resulting from your use of our service that damages you or any other party.

12. Copyright

The Client retains the copyright to data, files and graphic logos provided by the Client, and grants Aim High Web Design the rights to publish and use such material. The Client must obtain permission and rights to use any information or files that are copyrighted by a third party. The Client is further responsible for granting Aim High Web Design permission and rights for use of the same and agrees to indemnify and hold harmless Aim High Web Design from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions. A contract for website design and/or placement shall be regarded as a guarantee by the Client to Aim High Web Design that all such permissions and authorities have been obtained. Evidence of permissions and authorities may be requested.

13. Standard Media Delivery

Unless otherwise specified in the project quotation, this Agreement assumes that any text will be provided by the Client in electronic format (ASCII text files delivered on floppy disk or via e-mail or FTP) and that all photographs and other graphics will be provided physically in high quality print suitable for scanning or electronically in .gif, .jpeg, .png or .tiff format. Although every reasonable attempt shall be made by Aim High Web Design to return to the Client any images or printed material provided for use in creation of the Client’s website, such return cannot be guaranteed.

14. Design Credit

A link to Aim High Web Design will appear in either small type or by a small graphic at the bottom of the Client’s website. If a graphic is used, it will be designed to fit in with the overall site design. If a client requests that the design credit be removed, a nominal fee of 10% of the total development charges will be applied. When total development charges are less than £5000, a fixed fee of £500 will be applied. The Client also agrees that the website developed for the Client may be presented in Aim High Web Design’s portfolio.

15. Access Requirements

If the Client’s website is to be installed on a third-party server, Aim High Web Design must be granted temporary read/write access to the Client’s storage directories which must be accessible via FTP. Depending on the specific nature of the project, other resources might also need to be configured on the server.

16. Post-Placement Alterations

Aim High Web Design cannot accept responsibility for any alterations caused by a third party occurring to the Client’s pages once installed. Such alterations include, but are not limited to additions, modifications or deletions.

17. Domain Names

Aim High Web Design may purchase domain names on behalf of the Client. Payment and renewal of those domain names is the responsibility of the Client. The loss, cancellation or otherwise of the domain brought about by non or late payment is not the responsibility of Aim High Web Design. The Client should keep a record of the due dates for payment to ensure that payment is received in good time.

18. General

These Terms and Conditions supersede all previous representations, understandings or agreements. The Client’s signature below or payment of an advance fee constitutes agreement to and acceptance of these Terms and Conditions. Payment online is an acceptance of our terms and conditions.

19. Social Media Management

Social Media Marketing and Management is defined as helping a client to promote their products or services through social media channels. Aim High Web Design will honour the components of your chosen social media package, providing an agreement to a minimum 3 months contract is served and monthly payments are received in advance. In the event that payment is not received on time, we regret that further work will be halted until this is rectified.

20. Website Hosting

Whilst Aim High Web Design provides website hosting services, no guarantees can be made as to the availability or interruption of this service. Aim High Web Design cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Aim High Web Design reserves the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the hosting service should the necessity arise.

21. Website Care Plans

If the client has a website care plan in place the specifics of what is included will be highlighted on the agreement signed upon entering into the website care plan.

If your website gets hacked, Aim High Web Design will not be held responsible and therefore exlcudes itself from any liability.  If the client’s care plan covers ‘Website recovery service’ every effort will be made to get he clients website back up and running, however this could inccur addtional costs.  In this case we would create a plan of action and give the client options.

Any investigation or restorative work are additional and charged hourly.

We are not held responsible or liable for any loss of data or business from a site crash

22. Governing Law

This Agreement shall be governed by English Law.

23. If you are unhappy with your site

Anyone who experiences a problem with their web service should raise the matter directly using our online contact form to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.

Aim High Web Design will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

24. Warranty

If anything goes wrong with the clients website, at any time within 30 days after launch Aim High Web Design will fix without any charge.  This excludes any issues arising due to the client making chnages to the website.  Due to this we usually agree that clients will not be granted access to make changes for the first 30 days after launch so that Aim High Web Design can ensure full stability of the website without any other factors causing issues.  If a client wishes to have access within the first 30 days after launch the warrantly will be voided and any issues will be chargable.

After the 30 days all additional work (design, layout and functionality) will be billed at a minimum of 1 hour’s work.

25. Service Level Agreements

Urgent support issues

Should there be a technical problem with your site, email account or domain, we will always treat it as our top priority. We will always attempt to resolve the problem as quickly as possible and get your services back up and running as they should be.

Minor amends (less than 1 hour of design work)

Should you request an update to your website that will take us less than 1 hour to complete, we will normally complete the update within 2 working days.

Small amends (1-3 hours of design work)

Should you request an update to your website that will take us between 1 and 3 hours to complete, we will normally complete the update within 5 working days.

Medium sized amends (up to 1 day of design work)

Should you request an update to your website that will take us up to a full working day to complete hours to complete, we will normally complete the update within 10 working days.

Larger and more technically complicated jobs

If you have a bigger piece of work that needs completing, how long it can take will depend on the size of the job, the complexity of the work, and possibly  a number of other factors. Normally however we would expect to complete most jobs within 20 to 30 working days. For larger piece of work, please ask us how long it will take for an accurate estimate.

New websites, or a redesign of an existing website

Currently a website redesign is normally expected to be completed within 20 to 30 working days.

Urgent work

Should you need the work completed urgently by a deadline that allows less time than we would normally require for that particular amend, we normally charge an extra % additional fee for the work.

  • Website inside 1 week guaranteed from when we receive all the content – The price of the website + 50% (If a website costs £399, then you would pay £598.50)
  • Website inside 2 weeks guaranteed from when we receive all the content – The price of the website + 25%  (If a website costs £399, then you would pay £498.75)

Emergency and out of hours design work

Should you need us to immediately start work on your project or design updates and complete the work as quickly as possible, we normally charge an extra 50% additional fee for the work. Should you require us to work over a weekend, or outwith normal working hours to complete your project within the required deadline, we normally charge a 100% additional fee.

Urgent, emergency and out of hours work will only be accepted at our discretion. We will inform you before agreeing to start this type of work what our rate for the work will need to be to complete the work within the required deadline.

Please note

Please note that all expected completion times are measured from the time at which we receive all the material required to complete the work.

This material may include text, imagery, video, or any other information needed to complete the job, such as questionnaire responses, answers to queries, access to hosting, etc. If we haven’t received all the information we have requested, we will not start work on the project.

26. Miscellaneous Terms

  • Turnaround times are estimates based on average past performance unless otherwise indicated.
  • If commissioning an ecommerce website, please note that we do not add all your products due to time constraints when building your site.
  • We retain the copyright on all materials produced e.g. logos, website designs, business cards until the entirety of the package signed up for is paid for. Once this is done, copyright of any design work is transferred to you. We retain the right to include the produced work in our portfolio. The website manager remains the intellectual property of Aim High Web Design.
  • Stock images we provide are for use on your website only and allowances as part of your package and/or add-ons expire once your website is launched.
  • With services provided for print such as business cards and letterheads, we only provide the design portion of the process and do not provide any printing services.
  • We will provide finished digital copies of design works such as business cards and letterheads. These files will be flattened version in a high quality format. We will not provide editable files such as illustrator files. We can make future edits to these designs on your request. Our standard hourly rate will apply.
  • Content writing per page fee includes a maximum of 500 words per a page. Longer pages will be charged as a multiple of the per page fee.
  • We will endeavour to check the content we produce as part of our content writing service for errors in terms of grammar, spelling and factual accuracy however the ultimate responsibility for these elements will fall on you the client. We accept no responsibility for errors once published.
  • We do not proof read any content you provide for your website. We accept no responsibility for errors.
  • Features of ongoing packages do not roll over. Any allowances expire at the end of the given period.
  • Unless otherwise stated, offers cannot be used in conjunction with other promotions.
  • Email accounts provided with website packages are provided through a webmail interface. Other access such as IMAP and Activesync can be provided at an additional cost. If you wish you an use another email service with your website.
  • If your package includes SSL security, the feature must be requested during the build of your website. Requests to add this after the launch of your site will incur a setup fee.
  • When instructing a company to print items we have designed such as business cards and letterheads, it is your responsibility to ensure the print quality. We accept no responsibility should finished printed items not accurately reproduce colours or quality.
  • If your package includes search optimisation, your chosen target keywords can only be changed once every 3 months.
  • Social Media setup includes the setup of Twitter and Facebook accounts only. You will need a personal Facebook account so that we can make you the owner of the Facebook Page we set up for you. Without a personal Facebook account you will not be able to manage the Facebook Page. It is your responsibility to set up your personal account. Social Media setup is not required if you already have business pages / accounts set up and just want us to link to them from your new site.
  • For Ecommerce websites we only integrate with Paypal, Stripe, Sagepay and Worldpay gateways. As part of your setup you may need to configure elements of the integration within the respective gateway’s systems. We will provide guidance as to any changes that need to be made however support for specifics within those systems must come for the gateway themselves. We can sometimes make the changes on your behalf but reserve the right to charge a small fee for this.
  • The contract between you and Aim High Web Design is entered into under the exclusive jurisdiction of the courts of England and Wales.
  • The security and well being of our staff is of paramount important. Abusive behaviour such as swearing or threatening a member of our team will not be tolerated. Should behaviour of this nature occur we reserve the right to terminate your contract with the full forfeit of any monies paid to date. We are always happy to and wish to address any concerns you have however this should be done in a mutually respectful manor.
  • At our discretion, up until the point of starting your design we reserve the right to cancel the order and issue a full refund for any reason we deem as appropriate.

27. Liability

Aim High Web Design hereby excludes itself, its Employees and or Agents from all and any liability from:

  • Loss or damage caused by any inaccuracy;
  • Loss or damage caused by omission;
  • Loss or damage caused by delay or error, whether the result of negligence or other cause in the production of the web site;
  • Loss or damage to clients’ artwork/photos, supplied for the site. Immaterial whether the loss or damage results from negligence or otherwise.

The entire liability of Aim High Web Design to the Client in respect of any claim whatsoever or breach of this Agreement, whether or not arising out of negligence, shall be limited to the charges paid for the Services under this Agreement in respect of which the breach has arisen.
